1. Agreement to Terms

These Terms of Service ("Terms") constitute a legal agreement between you ("Customer," "you," or "your") and Central PA Rose Co. ("Company," "we," "us," or "our"). By accessing and using our website at centralparoseco.com (the "Site") and placing orders for our products and services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or purchase our products.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following any modifications constitutes your acceptance of the modified Terms.

2. Products and Services

2.1 Product Description

Central PA Rose Co. offers premium handcrafted rose bouquets with 24 to 200 long-stem roses. Each bouquet includes personalized message cards, complimentary wine, and free delivery throughout Central Pennsylvania (Harrisburg, Lancaster, York, Enola, Hershey, and surrounding areas).

2.2 Availability

All products are subject to availability. While we make every effort to maintain accurate inventory, we do not guarantee that all products will be available at all times. If a product becomes unavailable after you place an order, we will notify you immediately and offer alternative options or a full refund.

2.3 Pricing

All prices are displayed in US Dollars (USD) and include applicable taxes and fees. We reserve the right to change prices at any time. Prices are subject to change without notice. The price charged will be the price in effect at the time you place your order. Promotional discounts (including early bird discounts) are valid only during specified periods and cannot be combined with other offers unless explicitly stated.

3. Ordering and Payment

3.1 Order Placement

When you place an order through our Site, you are making an offer to purchase our products. Your order is subject to acceptance by us. We reserve the right to refuse or cancel any order at our sole discretion, including orders that appear to be fraudulent or violate these Terms.

3.2 Payment Processing

Payment for orders is processed through Stripe, a third-party payment processor. By providing your payment information, you authorize us to charge your payment method for the full order amount. You represent and warrant that you are authorized to use the payment method provided and that all information is accurate and complete.

3.3 Order Confirmation

Upon successful payment, you will receive an order confirmation email containing your order number, delivery date, and order details. This confirmation does not constitute acceptance of your order until we send you a separate acceptance email.

3.4 Payment Disputes

If you dispute a charge or initiate a chargeback with your credit card company, we reserve the right to cancel your order and suspend your account. Chargebacks may result in additional fees and legal action.

4. Delivery and Fulfillment

4.1 Delivery Areas

We deliver to Harrisburg, Lancaster, York, Enola, Hershey, Carlisle, Mechanicsburg, State College, and surrounding communities in Central Pennsylvania. You can verify delivery availability for your address during checkout by entering your zip code.

4.2 Delivery Dates and Times

We offer scheduled Valentine's Day delivery (February 10-14) and same-day delivery options during regular business hours. Delivery dates and times are estimates only and subject to change based on weather, traffic, and other circumstances beyond our control. We will make every effort to deliver on your requested date and time window.

4.3 Delivery Responsibility

Once a bouquet is delivered and left at the delivery address, we are no longer responsible for the product. If you are not available at the delivery address, we may leave the bouquet in a safe location or with a household member. Please ensure someone is available to receive the delivery.

4.4 Failed Delivery

If we are unable to deliver your order due to an incorrect address, inability to locate the address, or no one available to receive the delivery, we will attempt to contact you. If we cannot reach you or complete the delivery, we may hold the bouquet for pickup or issue a refund at our discretion.

4.5 International Delivery

We do not currently offer international delivery. All deliveries are limited to Central Pennsylvania as specified above.

5. Product Quality and Guarantees

5.1 Fresh Guarantee

We guarantee that all roses are fresh and of premium quality. Our roses are cut fresh and arrive within 48 hours of harvest. We guarantee that roses will remain fresh and beautiful for at least 14 days with proper care. If your roses do not meet our quality standards, please contact us within 24 hours of delivery with photos, and we will replace them free of charge.

5.2 Satisfaction Guarantee

We stand behind every bouquet we create. If you are not completely satisfied with your order, please contact us within 24 hours of delivery. We will work with you to resolve any issues, including offering replacements or refunds at our discretion.

5.3 Limitations

Our guarantees do not apply to damage caused by improper care, mishandling after delivery, or circumstances beyond our control (such as extreme weather or natural disasters). Rose longevity depends on proper care, including regular water changes, stem trimming, and appropriate temperature conditions.

6. Refunds and Cancellations

6.1 Cancellation Policy

Orders can be cancelled up to 48 hours before the scheduled delivery date. Cancellation requests must be submitted in writing to [email protected]. Cancellations requested less than 48 hours before delivery may not be possible, and you may be charged the full order amount.

6.2 Refund Policy

Refunds are issued for cancelled orders (if cancelled within the 48-hour window) or for orders that fail to meet our quality standards. Refunds will be processed to your original payment method within 5-7 business days. Refunds for quality issues require photographic evidence and must be requested within 24 hours of delivery.

6.3 Non-Refundable Items

Complimentary wine and personalized message cards are non-refundable. If you receive a bouquet but do not wish to keep it, you may request a refund for the rose bouquet only, not for included complimentary items.

6.4 Promotional Discounts

Promotional discounts (including early bird discounts) are non-refundable. If you cancel an order that included a promotional discount, the refund will be based on the discounted price paid, not the full retail price.

7. User Conduct and Restrictions

7.1 Prohibited Activities

You agree not to use our Site for any unlawful or prohibited purpose, including:

• Violating any applicable laws or regulations
• Infringing on intellectual property rights
• Harassing, threatening, or abusing others
• Transmitting viruses, malware, or harmful code
• Attempting to gain unauthorized access to our systems
• Engaging in fraudulent or deceptive practices
• Spamming or sending unsolicited communications
• Scraping or automatically accessing our Site without permission

7.2 Account Responsibility

If you create an account on our Site, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

8. Intellectual Property Rights

All content on our Site, including text, images, logos, graphics, and software, is the property of Central PA Rose Co. or our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or transmit any content without our prior written permission.

You retain ownership of any content you submit to us (such as reviews or messages), but you grant us a non-exclusive, royalty-free license to use, reproduce, and display such content for business purposes.

9. Limitation of Liability

To the fullest extent permitted by law, Central PA Rose Co. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site or products, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of our Site shall not exceed the amount you paid for the order in question.

10. Disclaimer of Warranties

Our Site and products are provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the Site or products, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

11. Indemnification

You agree to indemnify, defend, and hold harmless Central PA Rose Co. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from your violation of these Terms, your use of our Site, or your orders.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our Site shall be resolved in the state or federal courts located in Pennsylvania.

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Central PA Rose Co. regarding your use of our Site and purchase of our products. These Terms supersede all prior agreements and understandings, whether written or oral.
